Living Will - How to Write One

"Do you have a Living Will?"  Emergency health care providers now commonly ask the question as they gather pertinent information about an individual who is about to receive medical treatment.  A Living Will is a written statement informing your family and your physician why type care you want or do not want if you become unable to make life prolonging decisions yourself.  Surveys indicate most Americans are in favor of advance directives or Living Wills but only about a third of us have actually written one.

It is not necessary that you have an attorney draw up your Living Will.  Kentucky Law (KRS 311.185) actually specifies the form you should fill out.  You probably would be advised to see an attorney if you make changes to the form which appears on the next page.  The law also prohibits relatives, heirs, health care providers or guardians from witnessing the Will.  You may wish to use the services of a Notary Public in lieu of witnesses.
